The right to a lawyer upon arrest

This article explains a fundamental right guaranteed to any person arrested or detained in Canada.

In Canada, anyone arrested or detained has the right to be promptly informed of their right to counsel. They also have the right to consult a lawyer promptly and in private. This right is protected by section 10(b) of the Canadian Charter. The police must cease all questioning until the individual has had an opportunity to exercise this right. If this right is not respected, the evidence obtained could be excluded from the trial.
